Terms of Service

Effective: May 19, 2026

1. Acceptance

By creating an account or using Tinkerix ("Service"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you are using Tinkerix on behalf of a school or district, you represent that you are authorized to bind that institution to these Terms.

2. Eligibility — educators only

Accounts are restricted to teachers, instructors, school administrators, tutors, instructional coaches, curriculum designers, and comparable educators who are at least 18 years old (or the age of majority in their jurisdiction). Students must not create Tinkerix accounts. Students may participate in an activity that a teacher assigns to them without any account or login.

3. Plans, credits, and billing

Tinkerix offers a Free tier and paid plans. Generation, regeneration, and modification each consume one credit. Browsing, viewing your library, or opening another teacher's Community Gallery activity does not consume credits. Paid plans are billed in advance via Stripe and renew until cancelled. Credits do not have monetary value, are non-refundable, and do not roll over unless the plan states otherwise.

4. Acceptable use — classroom-appropriate content only

You agree not to:

  • Generate content that is unlawful, harassing, hateful, discriminatory, sexually explicit, graphically violent, or otherwise unsafe for a K–12 or higher-ed classroom.
  • Generate content that promotes self-harm, eating disorders, substance abuse, or weapons-making.
  • Use the Service to bully, target, or shame an identifiable student or staff member.
  • Attempt to bypass rate limits, plan limits, or authentication.
  • Reverse engineer, scrape, or resell the Service.
  • Upload material you do not have rights to use, or use the Service to infringe copyright.

We may suspend or terminate accounts that violate these terms. Educators are expected to follow their school's responsible-use and AI-use policies.

5. Teacher responsibilities regarding student data

You are responsible for ensuring your use of Tinkerix complies with your school's policies, FERPA, COPPA, and applicable state student-privacy laws (e.g. SOPIPA, NY Ed Law § 2-d, Illinois SOPPA, Colorado SDTSA). In particular, you agree:

  • Do not enter student personally identifiable information into prompts or uploaded documents. This includes student names, photographs, student IDs, addresses, contact info, grades, IEPs, 504 plans, disciplinary records, health information, or any other education record covered by FERPA. Use first names only when truly necessary, or pseudonyms.
  • You will obtain any consents required by your school or local law before assigning Tinkerix activities to students.
  • You will review every AI-generated activity before assigning it to students for accuracy, age-appropriateness, bias, and alignment to your learning objectives.
  • You will not share your account credentials with students or other adults.

6. Data Privacy Agreements for schools and districts

Schools and districts that require a signed Data Privacy Agreement (DPA), including state-specific exhibits such as the National Data Privacy Agreement (NDPA), the New York Ed Law § 2-d supplemental information, the California SOPIPA addendum, or similar instruments, may request one at legal@tinkerix.app. When a DPA is executed, its terms govern in the event of a conflict with these Terms for the data covered by the DPA.

7. Your content

You retain ownership of the prompts and documents you submit and of the activities generated for you. You grant Tinkerix a worldwide, royalty-free license to process them solely to operate the Service (including sending them to our AI provider to generate an activity, and hosting the resulting activity so students can play it). Tinkerix does not use teacher prompts, uploaded documents, generated activities, or any student interactions to train AI models. Activities you mark as shared to the Community Gallery may be viewed and remixed ("Use as starting point") by other teachers; do not share an activity that contains content you do not have rights to redistribute.

8. AI-generated content — teacher review required

Activities are generated by an AI model and may contain errors, omissions, outdated information, or biases. You are responsible for reviewing any activity before using it with students. Tinkerix makes no warranty that generated content is accurate, age-appropriate, free of bias, or aligned to any specific curriculum or learning standard. Do not use Tinkerix as the sole source of instruction or assessment for high-stakes purposes.

9. Accessibility

We strive to make Tinkerix and the activities it generates usable by students with diverse needs (keyboard navigation, readable fonts, color contrast, mobile sizing). Because AI output varies, teachers are responsible for verifying that a specific activity meets the accessibility needs of their students and for requesting modifications when needed.

10. Service availability

We strive for high uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. Where reasonable we will give advance notice of material changes that affect schools.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TINKERIX DOES NOT WARRANT THAT AI-GENERATED CONTENT IS ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR STUDENT OR CURRICULUM.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINKERIX'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Some jurisdictions do not allow these limitations; in those jurisdictions liability is limited to the smallest extent permitted by law.

13. Termination

You may close your account at any time from your Account page or by emailing legal@tinkerix.app. We may terminate or suspend access for violation of these Terms or for legal/operational reasons. On termination, the license rights granted above end except as needed to wind down the Service, and we will delete account data as described in the Privacy Policy.

14. Governing law

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Ohio, except where a school or district customer is bound by law to a different venue, in which case the parties will negotiate a mutually acceptable forum in good faith.

15. Changes

We may update these Terms. Material changes — particularly any that affect student privacy or school obligations — will be announced by email and in-product notice in advance. Continued use after the effective date constitutes acceptance.
