Terms of Service

Effective: May 12, 2026

1. Acceptance

By creating an account or using Tinkerix ("Service"), you agree to these Terms of Service ("Terms"). If you are using Tinkerix on behalf of a school or district, you represent that you are authorized to do so.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and a teacher, instructor, school administrator, or comparable educator to hold an account. Students are welcome to interact with tools assigned by a teacher but should not create their own accounts.

3. Plans, credits, and billing

Tinkerix offers a Free tier and paid plans. Generation, regeneration, and modification each consume one credit. Browsing, viewing your library, or using another teacher's gallery tool does not consume credits. Paid plans are billed in advance via Stripe and renew until cancelled. Credits do not have monetary value, are non-refundable, and do not roll over unless the plan states otherwise.

4. Acceptable use

You agree not to:

  • Use the Service to generate content that is unlawful, harassing, hateful, sexually explicit, or unsafe for a classroom.
  • Attempt to bypass rate limits, plan limits, or authentication.
  • Reverse engineer, scrape, or resell the Service.
  • Upload material you do not have rights to use.

We may suspend or terminate accounts that violate these terms.

5. Your content

You retain ownership of the prompts and documents you submit. You grant Tinkerix a worldwide, royalty-free license to process them solely to operate the Service (including sending them to our AI provider to generate a tool). Tools you mark as shared to the Community Gallery may be viewed and remixed ("Use as starting point") by other teachers.

6. AI-generated content

Tools are generated by an AI model and may contain errors, omissions, or biases. You are responsible for reviewing any tool before using it with students. Tinkerix makes no warranty that generated content is accurate, age-appropriate, or aligned to a specific standard.

7. Service availability

We strive for high uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. Where reasonable we will give advance notice of material changes.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINKERIX'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Termination

You may close your account at any time. We may terminate or suspend access for violation of these Terms or for legal/operational reasons. On termination, the license rights granted above end except as needed to wind down the Service.

11. Governing law

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Ohio.

12. Changes

We may update these Terms. Material changes will be announced by email or in-product notice. Continued use after the effective date constitutes acceptance.
